1) Agreement to Terms
By using www.theunburrito.com (the “Site”), you agree to these Terms. If you do not agree, do not use the Site.
2) Changes to These Terms
We may update these Terms from time to time. The Effective Date above shows the latest version. If you continue using the Site after changes are posted, you accept the updated Terms.

4) Products & Availability
Information about products (including descriptions, nutrition, ingredients, and availability) may change without notice. We try to be accurate, but mistakes may occur; we reserve the right to correct errors, inaccuracies, or omissions.
5) Orders & Acceptance
Placing an order is an offer to buy. We may accept or reject any order at our discretion (for example, due to product availability, suspected fraud, or pricing/description errors). If we cancel or cannot fulfill your order, we will issue a refund for any amount charged.
6) Pricing, Taxes & Payment
Prices are shown in U.S. dollars unless stated otherwise and exclude applicable taxes, shipping, and fees, which will be shown at checkout. By submitting an order, you authorize us and our payment processors to charge your selected payment method for the total amount. We do not store full payment card numbers; processing is handled by our third-party payment processors.
7) Shipping, Delivery & Risk of Loss
Overnight service & insulated packaging. We ship orders overnight, Monday–Thursday, in premium insulated packaging (thick foam walls, reinforced outer box, and cold packs) to help keep products cold and protected in transit. We do not ship Friday–Sunday or on certain holidays due to perishability. We do not ship to P.O. Boxes.
Where we ship. U.S. street addresses only (no P.O. Boxes or U.S. territories at this time).
Processing time. Orders typically process within 1–3 business days. Processing times may be longer during peak periods.
Transit & tracking. Transit time depends on your location and the weather conditions. You will receive a shipping confirmation with tracking when your order leaves our facility.
Delivery & risk of loss. Title and risk of loss pass to you upon carrier scan of delivery at the address you provide. Please ensure your shipping address is correct; we are not responsible for non-delivery due to address errors. Carrier delays (including weather holds) are outside our control. We do not replace or refund for theft after a carrier-delivered scan (porch piracy).
Perishable items. Products are perishable. Refrigerate promptly after receiving. If a shipment arrives significantly damaged, contact info@cutterandcookfoods.com within 24 hours of delivery and include clear photos of
(i) the outer box
(ii) insulation
(iii) cold packs
(iv) the product
(v) the shipping label
Only with all of this information will we be able to determine if and how we will be able to remedy.
Final sale. All purchases are final and non-refundable.
8) Returns & Refunds
No refunds; replacements only for qualifying issues. Due to food safety, we cannot accept returns of opened or perishable items. If your order arrives damaged or incorrect, email info@cutterandcookfoods.com within 24 hours of delivery with your order number and required photos (see §7).
Order changes/cancellations. We begin processing orders quickly. If you need to change or cancel an order, email us as soon as possible; we can only accommodate requests that reach us before fulfillment has begun.
9) No Resale; Order Limits
We may limit or prohibit orders that, in our judgment, appear to be placed by unauthorized dealers, resellers, or distributors. Products are for personal use unless we expressly agree otherwise.
10) Health, Safety & Allergen Information
Always read labels, ingredient lists, and preparation/handling instructions provided with the product. If you have food allergies or sensitivities, consult the ingredient statement and contact us with questions before consuming. The Site does not provide medical advice and is not a substitute for professional guidance.
11) Acceptable Use
Please use the Site responsibly. Do not:

Break the law or infringe others’ rights.

Upload or transmit malware or anything harmful.

Access or attempt to access areas or systems you are not authorized to use.

Interfere with or disrupt the Site’s operation.

Use automated tools (bots, scrapers) to collect data from the Site.

Reverse engineer or attempt to extract source code where not allowed by law.
12) Intellectual Property
All content on the Site (including text, graphics, logos, images, and software) is owned by or licensed to Cutter and Cook Foods LLC and protected by law. You may view the Site for personal, non-commercial use. Do not copy, modify, distribute, or create derivative works without permission.
13) Promotions, Coupons & Gift Cards
Promotions, discount codes, and gift cards (if offered) are subject to terms stated at the time of offer and may be modified or ended at any time. They are not redeemable for cash except as required by law.
14) Third-Party Links & Services
The Site may link to third-party websites or services. We are not responsible for third-party content, products, or practices. Your use of third-party services is at your own risk and may be governed by separate terms and policies.
15) Accessibility

16) Disclaimer
THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
17) Limitation of Liability
To the maximum extent permitted by law, the Company and its affiliates, officers, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, data, or goodwill arising from or related to your use of the Site or products.
Cap on liability. If we are found liable for a claim related to the Site or a purchase, our total liability to you will not exceed the price you actually paid for the specific product(s) that gave rise to the claim (excluding shipping/taxes) or US $100, whichever is greater. This cap does not limit liability that cannot be limited by law (e.g., fraud or willful misconduct).
18) Indemnity
You agree to indemnify and hold harmless the Company and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or violation of these Terms.
19) Dispute Resolution — Binding Arbitration; No Class Actions
Any dispute or claim arising out of or relating to these Terms, the Site, or any purchase will be resolved by binding arbitration administered by a recognized arbitration provider (e.g., AAA) under its applicable consumer rules and governed by the U.S. Federal Arbitration Act. The arbitration will take place in Texas, USA, or by video/teleconference where permitted. You and Cutter and Cook Foods LLC waive any right to a jury trial and to participate in a class or representative action. Either party may bring an individual claim in small-claims court where allowed.
20) Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, acts of terrorism, labor disputes, government actions, supply-chain disruptions, or internet/utility failures.
21) Changes to the Site
We may modify or discontinue the Site or any features at any time without notice.
22) Miscellaneous
These Terms are the entire agreement between you and Cutter and Cook Foods LLC regarding the Site and supersede prior agreements. If any provision is found unenforceable, it will be limited to the minimum extent necessary, and the remainder will remain in effect. You may not assign these Terms without our consent; we may assign them as part of a reorganization, merger, or asset transfer. Our failure to enforce any right is not a waiver.
